1. Introduction & Definitions

Welcome to Flare

Welcome to Flare.

These Terms of Service (“Terms”) govern your access to and use of Flare, including our mobile applications, website, companion applications, APIs and any related products, services or features (collectively, the “Platform”).

The Platform is operated by Backroom Studio Ltd, a company incorporated in England and Wales (company number 17282807), with its registered office at Flat 402 Dunlip House, 2 William Murdoch Road, London E14 0YH, United Kingdom.

Throughout these Terms:

  • “Flare”, “we”, “our”, and “us” refer to Backroom Studio Ltd.
  • “you” and “your” refer to any individual using the Platform.
  • “Platform” means all Flare services, applications and websites.
  • “Content” means any information uploaded, created, transmitted or displayed through the Platform.
  • “Services” refers to user-created or business-created service listings available through Flare.
  • “Communities” refers to user-created groups within the Platform.
  • “Meetups” refers to user-created events and gatherings.
  • “Venues” refers to businesses and places shown on the Flare Map.
  • “Private Albums” refers to media collections that users choose to share with selected individuals.
  • “Open” refers to Flare’s optional feature allowing greater profile visibility to nearby users.
  • “Nearby” refers to Flare’s proximity-based discovery system.

Purpose of Flare

Flare is an adults-only social discovery, dating and community platform.

Our goal is to help adults safely connect through:

  • Friendships.
  • Dating.
  • Relationships.
  • Communities.
  • Meetups.
  • Venues.
  • Services.
  • Shared interests.
  • LGBTQ+ spaces.
  • Social networking.

Although Flare was designed with LGBTQ+ communities in mind, the Platform is open to all adults who comply with these Terms.

Acceptance of These Terms

By creating an account, accessing or using Flare, you confirm that you:

  • Have read these Terms.
  • Understand these Terms.
  • Agree to be legally bound by these Terms.
  • Agree to comply with our Community Guidelines.
  • Acknowledge our Privacy Policy.
  • Meet all eligibility requirements described in these Terms.

If you do not agree with these Terms, you must not use Flare.

Related Policies

These Terms work together with other important documents that govern your use of Flare.

These include:

  • Safety Center.
  • Cookie Policy.
  • Any additional policies published for specific features.

Where these Terms conflict with mandatory rights provided by applicable law, those legal rights will prevail.

Adults-Only Platform

Flare is intended exclusively for adults aged 18 years or older.

Access by anyone under 18 is strictly prohibited.

We use age-assurance measures to help enforce this requirement.

Updates to the Platform

Flare continually evolves.

We may introduce:

  • New features.
  • New subscription plans.
  • New safety measures.
  • New moderation systems.
  • New verification requirements.
  • New Communities.
  • New Venue features.
  • New Service features.
  • New AI-powered tools.

Some features may be modified, suspended or discontinued without prior notice where reasonably necessary.

We will endeavour to minimise disruption where practical.

Availability

Although we aim to provide a reliable service, Flare cannot guarantee uninterrupted availability.

The Platform may occasionally be unavailable due to:

  • Maintenance.
  • Security updates.
  • Technical failures.
  • Internet outages.
  • Third-party provider failures.
  • Force majeure events.
  • Compliance with legal obligations.

We are not responsible for temporary interruptions beyond our reasonable control.

Your Agreement

By continuing to use Flare, you acknowledge that:

  • Online interactions involve inherent risks.
  • Users remain responsible for their own decisions and interactions.
  • Flare provides a platform for users to connect but is not a party to relationships, agreements or transactions formed between users.

You agree to use the Platform responsibly and in accordance with these Terms.

2. Eligibility, Age Verification & Identity Verification

Eligibility Requirements

To create or use a Flare account, you must satisfy all of the following requirements.

You must:

  • Be at least 18 years of age.
  • Have the legal capacity to enter into a binding agreement in your country or jurisdiction.
  • Not be prohibited by applicable law from using the Platform.
  • Not have previously been permanently banned from Flare unless we have expressly authorised your return.
  • Provide truthful and accurate information when creating and maintaining your account.

By creating an account, you represent and warrant that you satisfy these requirements.

If you no longer satisfy these requirements, you must stop using the Platform immediately.

Adults-Only Community

Flare is designed exclusively for adults.

Individuals under the age of 18 are not permitted to:

  • Register.
  • Access the Platform.
  • Browse user profiles.
  • Participate in Communities.
  • Join Meetups.
  • Create Services.
  • Use messaging.
  • Access any adult-oriented features.

This restriction applies worldwide unless Flare expressly states otherwise in accordance with applicable law.

Age Assurance

To help maintain an adults-only community and comply with online safety legislation, Flare uses age-assurance technology provided by Didit.

During registration, you may be asked to complete an age estimation process using:

  • A selfie.
  • A liveness check.

Didit’s technology estimates whether you are likely to be at least 18 years old.

Flare receives only the outcome of the verification process.

Flare does not receive or retain:

  • Your verification selfie.
  • Your liveness video.
  • Biometric templates.
  • Facial recognition data.

Identity Verification

Some Platform features require additional identity verification.

Identity verification may be required if you:

  • Host a Meetup.
  • Create or manage a Venue.
  • Publish a Service listing.
  • Operate a business profile.
  • Access future features requiring enhanced trust.
  • Are required to verify your identity under applicable law.
  • Are selected for additional fraud prevention or safety checks.

Identity verification is performed through Didit using a government-issued identity document and associated verification technologies.

Flare receives only the verification outcome necessary to determine whether you have successfully completed the required checks.

Country-Specific Requirements

Age assurance and identity verification requirements may vary depending on the country or region in which you access Flare.

For example, certain jurisdictions require mandatory age verification before adults may access online services intended for adults.

Flare uses your approximate location and other information reasonably necessary to determine which legal requirements apply.

Verification requirements may change as laws evolve.

By using Flare, you acknowledge that verification requirements applicable to your account may change over time.

Verification Decisions

Verification outcomes may include:

  • Approved.
  • In Review.
  • Additional Verification Required.
  • Declined.

Where verification cannot be completed successfully, Flare may:

  • Delay activation of your account.
  • Restrict access to certain features.
  • Prevent hosting activities.
  • Suspend or terminate your account where appropriate.

Verification decisions are intended to protect the safety of the Platform and comply with applicable law.

Reverification

Flare may request that you complete verification again where reasonably necessary.

Examples include:

  • Suspected account compromise.
  • Fraud investigations.
  • Significant account changes.
  • Updates to verification technology.
  • Safety investigations.
  • Compliance with new legal requirements.

Failure to complete required reverification may result in temporary or permanent restrictions on your account.

False Information

You agree not to provide false or misleading information during registration or verification.

This includes, but is not limited to:

  • False name where identity verification is required.
  • False date of birth.
  • False country.
  • Altered identity documents.
  • Stolen identity documents.
  • Fraudulent verification attempts.

Providing false information may result in immediate enforcement action, including permanent account termination.

Verification Fraud

You must not attempt to interfere with, manipulate or circumvent Flare’s verification systems.

Prohibited conduct includes:

  • Using another person’s identity.
  • Using edited or forged documents.
  • Attempting to bypass age verification.
  • Using software to manipulate verification.
  • Submitting fraudulent biometric information.
  • Creating multiple accounts after verification failure.

Flare may permanently restrict accounts involved in verification fraud.

Circumventing Restrictions

You must not attempt to avoid:

  • Age verification.
  • Identity verification.
  • Regional verification requirements.
  • Suspensions.
  • Permanent bans.
  • Safety restrictions.

Examples include:

  • Creating replacement accounts.
  • Using VPNs or proxy services to bypass legal restrictions.
  • Manipulating device identifiers.
  • Using false locations.
  • Using another person’s verified account.

Attempts to circumvent Platform restrictions may result in permanent removal from Flare.

Verification Provider

Flare currently uses Didit to perform age and identity verification.

We may change verification providers in the future where reasonably necessary to improve:

  • User privacy.
  • Security.
  • Accuracy.
  • Fraud prevention.
  • Legal compliance.

If such changes materially affect how your personal information is processed, we will update our Privacy Policy and notify users where required by law.

Your Responsibilities

You are responsible for:

  • Providing accurate information.
  • Completing required verification honestly.
  • Maintaining accurate account information.
  • Updating information when it changes.
  • Protecting access to your verified account.

Failure to meet these responsibilities may affect your ability to use some or all Platform features.

No Guarantee of Identity

Although Flare uses verification measures to improve trust and safety, no verification system can guarantee the identity, honesty or intentions of every user.

Verification confirms only the matters that have been verified (such as age or identity, where applicable).

Users remain responsible for exercising appropriate caution when interacting with others both online and offline.

Our Right to Refuse Access

Flare reserves the right, where permitted by applicable law, to refuse registration or continued access to the Platform where we reasonably believe that doing so is necessary to:

  • Protect users.
  • Prevent fraud.
  • Maintain Platform integrity.
  • Comply with legal obligations.
  • Protect the rights of Flare or others.

Where appropriate, affected users may have access to the appeals process described elsewhere in these Terms.

3. Creating an Account

Registration

To access most features of Flare, you must create a personal account.

You may register using one of the supported methods available at the time of registration, including:

  • Email address.
  • Sign in with Apple.
  • Google Sign-In.
  • Meta (Facebook).
  • X.
  • Other authentication providers introduced in the future.

When using a third-party sign-in provider, you authorise that provider to share limited account information necessary to create and authenticate your Flare account.

Flare never receives or stores your password for third-party authentication providers.

One Person, One Primary Account

Each individual may maintain only one personal Flare account unless Flare expressly authorises otherwise.

You must not:

  • Create duplicate accounts.
  • Operate multiple personal accounts.
  • Share accounts with another person.
  • Allow another person to use your account.
  • Create replacement accounts to avoid restrictions or bans.

Where multiple accounts are permitted for business or testing purposes, they must be authorised by Flare.

Accurate Information

When creating an account, you agree to provide information that is:

  • Accurate.
  • Complete.
  • Current.
  • Truthful.

You must not intentionally provide false or misleading information, including but not limited to:

  • False names where identity verification is required.
  • False dates of birth.
  • False locations.
  • False photographs.
  • Impersonation of another person or organisation.
  • Misleading profile information.

You agree to keep your account information reasonably up to date.

Usernames & Display Names

You are responsible for choosing an appropriate username and display name.

Usernames and display names must not:

  • Impersonate another individual.
  • Mislead users into believing you represent Flare or another organisation.
  • Infringe intellectual property rights.
  • Promote illegal activities.
  • Contain hate speech.
  • Contain explicit sexual language.
  • Encourage violence.
  • Breach the Community Guidelines.

Flare may require usernames or display names to be changed where they violate these Terms.

Profile Information

You may personalise your profile using optional features available on the Platform.

Examples include:

  • Biography.
  • Pronouns.
  • Gender identity.
  • Sexual orientation.
  • Relationship status.
  • Relationship intentions.
  • Tribes.
  • Interests.
  • Languages.
  • Physical characteristics.
  • Social media links.
  • Gaming profiles.
  • Music preferences.
  • Profile photographs.
  • Profile videos.

Some profile information may be visible to other users depending on your privacy settings.

You remain responsible for the information you choose to publish.

Profile Photos & Videos

Profile media should accurately represent you and comply with our Community Guidelines.

You must not upload media that:

  • Belongs to someone else without permission.
  • Contains illegal content.
  • Contains child sexual abuse material.
  • Contains explicit public nudity where prohibited.
  • Contains graphic violence.
  • Promotes hate organisations.
  • Misrepresents your identity.
  • Infringes another person’s intellectual property.

Public profile media may be reviewed using AI-assisted moderation and, where appropriate, human moderation.

Keeping Your Account Active

You are responsible for maintaining your account.

This includes:

  • Updating outdated information.
  • Maintaining access to your email address.
  • Completing required verification requests.
  • Responding to important security notices where appropriate.

Failure to maintain accurate account information may affect your ability to access certain Platform features.

Business & Organisation Accounts

Where supported, Flare may permit businesses, venues, organisations or verified service providers to operate designated business accounts.

Business accounts may be subject to:

  • Additional verification.
  • Separate eligibility requirements.
  • Additional terms.
  • Commercial agreements.

Flare reserves the right to distinguish business accounts from personal accounts.

Communities, Meetups & Hosting

Creating a personal account does not automatically entitle you to:

  • Host Meetups.
  • Manage Communities.
  • Operate Venues.
  • Publish Services.

Certain features may require:

  • Identity verification.
  • Additional eligibility requirements.
  • Compliance with hosting standards.
  • Continued good standing on the Platform.

Account Ownership

Your Flare account is personal to you.

You may not:

  • Sell your account.
  • Transfer your account.
  • Rent your account.
  • License your account.
  • Gift your account.
  • Purchase another user’s account.

Flare accounts remain non-transferable unless expressly authorised by Flare.

Inactive Accounts

Flare may suspend, archive or remove inactive accounts where reasonably necessary to:

  • Maintain Platform integrity.
  • Improve security.
  • Free inactive usernames.
  • Comply with legal obligations.

Where practical, we may provide notice before permanently removing an inactive account.

Closing Your Account

You may close your account at any time through:

Settings → Delete Account

or through any additional account deletion methods made available by Flare.

Deleting your account begins the deletion process described in our Privacy Policy.

Certain information may be retained where required by law or for legitimate safety, fraud prevention or operational purposes.

Our Right to Refuse Registration

Flare reserves the right to refuse account creation where reasonably necessary to:

  • Protect users.
  • Prevent fraud.
  • Maintain Platform integrity.
  • Comply with legal obligations.
  • Enforce previous moderation decisions.
  • Protect Flare’s systems.

Where appropriate, users may contact Support if they believe registration has been refused in error.

4. Account Security

Your Responsibility

You are responsible for maintaining the security of your Flare account.

This includes taking reasonable steps to protect your account from unauthorised access or misuse.

You agree to:

  • Keep your login credentials confidential.
  • Use a strong and unique password if signing in with email.
  • Protect your authentication methods.
  • Keep your recovery information up to date.
  • Prevent unauthorised access to your devices.
  • Sign out of shared devices after use.

You remain responsible for activity carried out through your account unless applicable law provides otherwise.

Password Security

If you register using an email address and password, you must choose a password that is sufficiently secure.

We recommend using:

  • A unique password.
  • A combination of uppercase and lowercase letters.
  • Numbers.
  • Symbols.
  • A password manager where appropriate.

You must not:

  • Share your password with another person.
  • Reuse passwords from other services where possible.
  • Store passwords insecurely.
  • Intentionally disclose your credentials.

Flare will never ask you to reveal your password.

Passkeys

Where supported, Flare allows you to secure your account using passkeys (WebAuthn).

Passkeys provide a more secure alternative to traditional passwords and may reduce the risk of phishing and credential theft.

If you choose to enable passkeys, you remain responsible for securing the devices associated with them.

Two-Factor Authentication (2FA)

Flare may allow users to enable two-factor authentication (2FA).

Where enabled, an additional verification step is required before access to your account is granted.

We strongly encourage all users to enable 2FA where available.

Certain high-risk actions may require additional verification even if you have already signed in.

Social Sign-In Security

If you use a supported social sign-in provider, such as:

  • Apple
  • Google
  • Meta (Facebook)
  • X

the security of your Flare account may also depend on the security of that third-party account.

You are responsible for maintaining appropriate security on those accounts.

Flare is not responsible for unauthorised access resulting from the compromise of a third-party authentication provider account.

Keeping Your Information Up to Date

You should keep your account information current, including:

  • Email address.
  • Authentication methods.
  • Recovery information.
  • Verification status where applicable.

Failure to maintain accurate account information may delay account recovery.

Unauthorised Access

If you believe someone has gained unauthorised access to your account, you should immediately:

  • Change your password (where applicable).
  • Revoke active sessions if available.
  • Update your authentication methods.
  • Contact Flare Support.
  • Enable 2FA if not already enabled.

Prompt reporting helps us investigate and reduce the risk of further misuse.

Security Notifications

Flare may notify you about significant security events relating to your account.

Examples include:

  • New device sign-ins.
  • Password changes.
  • Authentication changes.
  • Verification updates.
  • Suspicious login attempts.
  • Account recovery requests.
  • Security alerts.

Some notifications are mandatory and cannot be disabled because they help protect your account.

Device Security

You are responsible for maintaining the security of devices you use to access Flare.

We recommend that you:

  • Lock your device with a passcode or biometric authentication.
  • Keep your operating system updated.
  • Install security updates promptly.
  • Avoid installing untrusted software.
  • Protect access to your email account.

Compromised devices may increase the risk of unauthorised access.

Lost or Stolen Devices

If a device containing access to your Flare account is lost or stolen, you should take reasonable steps to secure your account, including:

  • Changing your password if applicable.
  • Removing trusted devices where available.
  • Revoking active sessions.
  • Contacting Support if you believe your account has been compromised.

Prohibited Security Activities

You must not attempt to compromise the security of the Platform.

Prohibited activities include:

  • Attempting to access another user’s account.
  • Credential stuffing.
  • Password guessing.
  • Brute-force attacks.
  • Phishing.
  • Session hijacking.
  • Circumventing authentication systems.
  • Exploiting software vulnerabilities.
  • Reverse engineering security systems.
  • Interfering with Platform infrastructure.

Such activities may result in immediate suspension or permanent termination and may be reported to the appropriate authorities.

Security Monitoring

To protect users and the Platform, Flare may monitor security-related events, including:

  • Login attempts.
  • Authentication failures.
  • Device changes.
  • Unusual account activity.
  • Suspicious network behaviour.
  • Fraud indicators.

This monitoring is carried out in accordance with our Privacy Policy and applicable law.

Account Recovery

If you lose access to your account, Flare may request information reasonably necessary to verify that you are the rightful account holder before restoring access.

Recovery requirements may vary depending on:

  • Your authentication method.
  • Verification status.
  • Security history.
  • Applicable legal obligations.

We may decline recovery requests where ownership cannot be reasonably verified.

Temporary Security Restrictions

Where we reasonably believe your account may have been compromised, Flare may temporarily:

  • Restrict access.
  • Require password changes.
  • Require additional verification.
  • Suspend certain features.
  • End active sessions.
  • Delay sensitive account changes.

These measures are intended to protect both you and other users.

Our Commitment

Flare continuously improves its security measures to protect the Platform and its users.

  • AI-assisted fraud detection.
  • Bot protection.
  • Abuse prevention systems.
  • Secure authentication technologies.
  • Security monitoring.
  • Regular infrastructure improvements.

While we work to maintain a secure Platform, no online service can guarantee absolute security.

Users should always exercise appropriate caution when using internet services.

5. User Responsibilities & Acceptable Use

Your Responsibilities

By using Flare, you agree to use the Platform responsibly, respectfully and lawfully.

You are responsible for:

* Your behaviour on the Platform.

* Your interactions with other users.

* The content you upload or share.

* Maintaining the security of your account.

* Complying with these Terms.

* Complying with our Community Guidelines.

* Complying with applicable laws.

You remain responsible for your actions both online and, where relevant, during offline interactions arranged through the Platform.

Respect for Other Users

Flare is built to help adults form meaningful and respectful connections.

You agree to treat all users with dignity and respect.

You must not engage in behaviour intended to:

* Harass.

* Threaten.

* Intimidate.

* Humiliate.

* Bully.

* Stalk.

* Blackmail.

* Exploit.

* Manipulate.

* Coerce.

* Discriminate against others.

All interactions should respect personal boundaries and consent.

Compliance with the Community Guidelines

The Community Guidelines form an important part of your agreement with Flare.

By using the Platform, you agree to follow all rules contained within the Community Guidelines, including future updates.

Violations of the Community Guidelines may result in enforcement action under these Terms.

Lawful Use

You may use Flare only for lawful purposes.

You must not use the Platform to:

* Commit criminal offences.

* Facilitate illegal activity.

* Promote illegal goods or services.

* Commit fraud.

* Launder money.

* Traffic prohibited materials.

* Exploit vulnerable individuals.

* Circumvent legal obligations.

You are responsible for ensuring your use of Flare complies with the laws applicable to you.

Honest Participation

You agree to participate honestly.

You must not:

* Impersonate another person.

* Misrepresent your identity.

* Pretend to represent Flare.

* Use misleading profile information.

* Falsify verification.

* Create deceptive Communities.

* Create misleading Meetups.

* Publish fraudulent Services.

* Publish fake Venue information.

Honest participation helps maintain trust across the Platform.

No Fake Accounts

You must not:

* Create fake accounts.

* Create duplicate personal accounts.

* Create accounts for another person without permission.

* Sell or purchase accounts.

* Share accounts.

* Use accounts created through automated methods.

* Re-register after permanent suspension without authorisation.

Flare may remove fake or duplicate accounts without notice.

Respect for Consent

Consent is fundamental to Flare.

You must respect another person’s decisions regarding:

* Messaging.

* Calls.

* Private Albums.

* Meetups.

* Personal boundaries.

* Sharing photographs.

* Sharing videos.

* Physical interactions.

You must immediately respect a user’s decision to stop communicating or withdraw consent.

Spam & Unwanted Communications

You must not use Flare to send:

* Spam.

* Chain messages.

* Mass unsolicited communications.

* Repetitive messages.

* Automated messages.

* Unwanted commercial communications.

* Malicious links.

* Phishing attempts.

Users should contact others only in ways reasonably consistent with the purpose of the Platform.

Fraud & Financial Abuse

You must not use Flare to:

* Defraud users.

* Request money under false pretences.

* Operate scams.

* Promote investment fraud.

* Commit romance scams.

* Steal financial information.

* Facilitate payment fraud.

* Mislead users for financial gain.

Any suspected financial abuse may result in immediate enforcement action.

Platform Abuse

You must not interfere with the operation of the Platform.

Examples include:

* Reverse engineering.

* Scraping.

* Automated data collection.

* Excessive automated requests.

* Exploiting bugs.

* Attempting to bypass security measures.

* Interfering with moderation systems.

* Attempting to manipulate recommendations.

* Manipulating discovery algorithms.

* Artificially inflating engagement.

Flare reserves the right to investigate suspected abuse.

Prohibited Commercial Activity

Unless expressly permitted by Flare, you must not use the Platform to:

* Operate unauthorised advertising campaigns.

* Mass promote products.

* Send unsolicited commercial messages.

* Operate pyramid schemes.

* Conduct unauthorised fundraising.

* Promote illegal businesses.

Commercial activity should take place only through authorised Platform features, such as verified Service listings or approved advertising programmes.

Communities, Meetups & Services

If you create or manage a Community, Meetup, Venue or Service, you accept additional responsibilities.

You agree to:

* Provide accurate information.

* Keep listings reasonably up to date.

* Follow applicable laws.

* Respect participant safety.

* Avoid misleading users.

* Cooperate with moderation where reasonably requested.

Hosting privileges may be suspended if these responsibilities are not met.

Respect for Intellectual Property

You must respect the intellectual property rights of others.

You must not upload, distribute or use content that:

* Infringes copyright.

* Infringes trademarks.

* Violates publicity rights.

* Violates privacy rights.

* Misappropriates confidential information.

You are responsible for ensuring you have the necessary rights before sharing content.

Protecting Private Content

Private content shared through Flare is intended only for the recipient(s) authorised by the sender.

You must not:

* Redistribute private media.

* Publish another person’s private content.

* Record voice or video calls without consent where prohibited by law.

* Circumvent screenshot protection.

* Remove or alter digital watermarks.

* Attempt to identify or disable content protection systems.

Unauthorised disclosure of private content may result in immediate enforcement action and, where appropriate, legal action.

Cooperation with Safety Measures

You agree not to interfere with Flare’s safety systems.

This includes:

* Verification systems.

* AI moderation.

* Fraud detection.

* Abuse detection.

* Security monitoring.

* Investigation procedures.

* Appeals processes.

Flare encourages users to follow guidance published in our Safety Center.

Reporting Harmful Behaviour

We encourage users to report behaviour that may violate these Terms or the Community Guidelines.

Reports should be made honestly and in good faith.

Knowingly submitting false, malicious or abusive reports may itself violate these Terms.

Consequences of Violations

Violations of these Terms or the Community Guidelines may result in one or more enforcement actions, including:

* Educational notices.

* Warnings.

* Content removal.

* Feature restrictions.

* Temporary suspensions.

* Permanent account termination.

* Device-level restrictions where appropriate.

* Referral to law enforcement where legally required.

Licence Granted to Flare

To operate the Platform, you grant Flare a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to:

  • Store your content.
  • Copy your content.
  • Cache your content.
  • Display your content.
  • Distribute your content within the Platform.
  • Transmit your content.
  • Optimise your content.
  • Resize your content.
  • Generate thumbnails.
  • Convert file formats.
  • Protect your content.
  • Moderate your content.
  • Improve the Platform.
  • Provide Platform features requested by you.

This licence exists only for the purpose of operating, maintaining, securing and improving Flare.

It does not transfer ownership of your content to Flare.

Duration of the Licence

The licence granted under these Terms generally continues only while your content remains on the Platform.

When you delete content or delete your account, the licence normally ends, except where continued processing is reasonably necessary to:

  • Complete deletion processes.
  • Maintain encrypted backups.
  • Comply with legal obligations.
  • Investigate abuse.
  • Protect users.

Public content may be viewed, shared within the Platform and recommended to other users according to your privacy settings and Platform features.

Private Content

Private content is intended only for the people you choose to share it with.

  • Direct Messages.
  • Private Albums.
  • View Once media.
  • Shared locations.
  • Voice messages.
  • Calls.

Although private content is not publicly displayed, it may still be processed where reasonably necessary to:

  • Deliver communications.
  • Investigate reports.
  • Protect users.
  • Detect abuse.
  • Comply with legal obligations.

Flare does not routinely monitor every private communication.

AI Moderation

To help maintain a safe Platform, Flare may use AI-assisted systems to analyse content uploaded to the Platform.

  • Service listings.
  • Venue photographs.
  • Meetup media.

AI moderation helps identify content that may violate:

  • These Terms.
  • Community Guidelines.

  • Branding.

  • Trademarks.
  • Service marks.

Similarly, you must respect the trademark rights of other individuals and organisations.

Community Content

If you create or moderate a Community, you remain responsible for the content you publish within that Community.

Community owners and moderators should make reasonable efforts to ensure Community content complies with:

  • These Terms.
  • Community Guidelines.
  • Applicable law.

Flare may intervene where Communities present safety or legal concerns.

Meetup Content

Meetup organisers are responsible for ensuring that information they publish about Meetups is:

  • Accurate.
  • Lawful.
  • Not misleading.
  • Updated where appropriate.

Flare may remove Meetup content that violates these Terms or Community Guidelines.

Venue Content

Users submitting Venue reviews, photographs or other Venue-related information agree that such content should reflect genuine experiences.

You must not publish:

  • False reviews.
  • Misleading ratings.
  • Fraudulent photographs.
  • Fake check-ins.

Flare may remove content that undermines the integrity of Venue features.

Service Listings

Users creating Service listings remain solely responsible for:

  • Listing descriptions.
  • Images.
  • Claims made.
  • Prices discussed privately.
  • Compliance with applicable laws.
  • Delivering any services offered.

Flare does not endorse, guarantee or supervise Services offered by users.

Digital Watermarks & Content Protection

To help discourage unauthorised sharing, Flare may apply security technologies to certain media, including:

  • Visible watermarks.
  • Invisible digital watermarks.
  • Viewer-specific identifiers.
  • Screenshot attribution technologies.

These measures are intended solely to protect users and investigate unauthorised disclosures.

They do not transfer ownership of content to Flare.

User Warranties

By uploading content, you warrant that:

  • You have the legal right to share it.
  • It does not infringe another person’s rights.
  • It complies with these Terms.
  • It complies with the Community Guidelines.
  • It does not contain unlawful material.
  • It is not knowingly false or misleading.

You remain responsible for any consequences arising from unlawful or infringing content.

Flare Intellectual Property

The Platform itself-including its software, design, interface, graphics, branding, source code, databases and other proprietary materials-is owned by Flare or its licensors and is protected by intellectual property laws.

Except where expressly permitted, you may not:

Some communication features may only be available to certain subscription tiers.

Eligibility to Communicate

To help reduce unwanted contact and spam, some communication features may only become available when certain conditions are met.

For example:

  • Two users have matched.
  • A conversation has already been started.
  • Both users are members of the same Community.
  • Users are participating in the same Meetup.
  • Another feature specifically allows communication.

Flare may modify these requirements as the Platform evolves.

Respectful Communication

You agree to communicate respectfully with other users.

You must not use Flare’s communication features to:

  • Harass another person.
  • Threaten violence.
  • Intimidate.
  • Bully.
  • Stalk.
  • Blackmail.
  • Coerce.
  • Manipulate.
  • Send repeated unwanted messages.
  • Encourage self-harm.
  • Promote hatred.
  • Incite violence.

Respect for consent applies to all communications.

If another user asks you to stop contacting them, you must respect that decision.

Prohibited Communications

You must not use Flare’s messaging or calling features to:

  • Send spam.
  • Operate scams.
  • Request passwords.
  • Request banking information.
  • Share malware.
  • Share phishing links.
  • Share illegal material.
  • Distribute copyrighted material without permission.
  • Sell prohibited goods.
  • Recruit for illegal organisations.

Flare may immediately restrict accounts involved in serious abuse.

Adult Conversations

Flare is an adults-only platform.

Conversations between consenting adults may include discussions relating to relationships, dating or sexuality.

However, communications must always comply with:

  • Applicable law.

Content involving:

  • Minors.
  • Exploitation.
  • Coercion.

Voice & Video Calls

Flare supports voice and video calls between eligible users.

Calls:

  • Are not routinely recorded by Flare.

  • May require an active internet connection.

Users remain responsible for complying with applicable recording laws in their jurisdiction.

Recording Calls

Unless expressly permitted by applicable law and all participants have provided any legally required consent, you must not:

  • Secretly record voice calls.
  • Secretly record video calls.
  • Redistribute recorded conversations.
  • Publish another person’s private communications.

Unauthorised recordings may result in enforcement action.

View Once Media

Some media may be designated as View Once.

View Once content is intended to be viewed only once by the recipient.

Users must not attempt to:

  • Circumvent View Once functionality.
  • Duplicate View Once media.
  • Redistribute View Once media.
  • Capture View Once content without permission.

Technical limitations may prevent absolute enforcement on every device.

Private Albums

Private Albums allow users to share selected photographs and videos with specific people.

Access is granted solely at the discretion of the album owner.

Recipients must not:

  • Redistribute content.
  • Download content for unauthorised purposes.
  • Publish content elsewhere.
  • Share access with others.

Private Album access may be revoked at any time by the owner.

Screenshot Protection

Where supported by the operating system and device, Flare may:

Flare offers a range of discovery features designed to help adults connect with people, communities, venues, meetups and services that match their interests and preferences.

Discovery features are intended to increase opportunities for meaningful connections while respecting user privacy, consent and safety.

These features may evolve over time as Flare introduces new functionality.

Available Discovery Features

Depending on your subscription, location and account status, Flare may provide features including:

  • Nearby.
  • Open.
  • Swipe.
  • Grid.
  • Passport.
  • Travel Mode.
  • Suggested Users.
  • Suggested Communities.
  • Suggested Meetups.
  • Suggested Venues.
  • Suggested Services.
  • Search.
  • Filters.
  • Favourites.

Availability may vary by country, subscription plan or device.

Nearby

Nearby displays users who are geographically close to your approximate location.

To protect your privacy:

  • Flare never displays your precise GPS coordinates.
  • Distances shown are approximate and may be intentionally adjusted (“fuzzed”).
  • Your exact location is never visible to other users.

Nearby depends on device location permissions.

Disabling location services may reduce or disable Nearby functionality.

Open

Open is an optional feature that allows users to increase their visibility to nearby members.

When Open is enabled:

  • Your profile may appear to more nearby users.
  • Other users may discover you more easily.
  • Open does not guarantee profile views, matches or messages.

You remain in control of Open and may enable or disable it at any time through your settings.

Flare reserves the right to adjust how Open operates to improve user experience or platform safety.

Swipe

Flare does not guarantee that every user will appear in every Grid.

Passport & Travel Mode

Where available, Passport and Travel Mode allow users to explore other locations without physically travelling there.

  • Plan trips.
  • Meet people before travelling.
  • Explore events.
  • Discover venues.

Travel Mode changes discovery behaviour but does not necessarily replace your actual location for security, fraud prevention or legal compliance purposes.

Discovery Algorithms

Flare uses automated systems to improve recommendations across the Platform.

Recommendations may consider information such as:

  • Profile information.
  • Approximate location.
  • Interests.
  • Community participation.
  • Meetup attendance.
  • Previous interactions.

No Guaranteed Visibility

Flare cannot guarantee:

  • The number of profile views.
  • The number of likes.
  • The number of matches.

  • The number of attendees at Meetups.
  • Business enquiries through Services.

Profile visibility depends on many factors beyond Flare’s control.

Filters & Preferences

Flare may allow users to apply discovery filters.

Examples include:

  • Age.
  • Distance.
  • Gender.
  • Interests.
  • Relationship intentions.
  • Communities.
  • Online status.
  • Verification status.
  • Subscription features.

Filters are provided to improve user experience but cannot guarantee specific results.

Profile Ranking

Flare may determine the order in which profiles appear using automated systems.

Ranking may consider factors such as:

  • Location.
  • User preferences.
  • Safety considerations.

Users remain responsible for deciding whether to join Communities, attend Meetups, visit Venues or purchase Services.

  • Sponsored Businesses.
  • Promotional placements.
  • Paid advertisements.

Sponsored content will be identified where reasonably appropriate.

Paid placement does not imply endorsement by Flare.

Safety

Flare may reduce or remove a profile’s visibility where reasonably necessary to:

  • Protect users.
  • Prevent fraud.
  • Enforce these Terms.

Visibility changes may occur without prior notice where immediate action is necessary to protect the Platform.

9. Communities

Purpose

Flare Communities allow users to create and participate in groups based on shared interests, identities, hobbies, locations or other common connections.

Communities are intended to encourage respectful discussion, social interaction and community building.

Communities are created and managed by users, not by Flare.

Creating a Community

Eligible users may create Communities through the Platform.

When creating a Community, you agree to:

  • Provide accurate information.
  • Choose an appropriate name.
  • Use an appropriate description.
  • Select suitable categories.
  • Comply with these Terms.
  • Comply with the Community Guidelines.
  • Comply with applicable laws.

Flare reserves the right to refuse, remove or rename Communities that violate these Terms.

Community Owners

The creator of a Community becomes its owner unless ownership is transferred through features provided by Flare.

Community owners are responsible for:

  • Managing the Community.
  • Setting appropriate expectations for members.
  • Appointing moderators where available.
  • Helping maintain respectful discussions.
  • Reporting serious misconduct.
  • Cooperating with Flare where moderation assistance is required.

Community ownership does not grant authority over Flare or its moderation decisions.

Community Moderators

Community owners may appoint moderators where the Platform supports this feature.

Moderators may help:

  • Review discussions.
  • Remove inappropriate posts.
  • Manage membership.
  • Encourage respectful participation.
  • Report serious violations to Flare.

Moderators act on behalf of the Community, not on behalf of Flare.

Flare may remove moderator privileges where reasonably necessary.

Community Members

By joining a Community, you agree to:

  • Respect other members.
  • Follow the Community Guidelines.
  • Follow any additional Community rules that do not conflict with Flare’s Terms or Community Guidelines.
  • Participate respectfully.
  • Avoid disrupting discussions.

Membership in a Community is voluntary.

You may leave a Community at any time.

Community Content

Members remain responsible for the content they publish within Communities.

Examples include:

  • Posts.
  • Comments.
  • Images.
  • Videos.
  • Polls.
  • Files where supported.
  • Links.
  • Reactions.

Community content must comply with:

  • These Terms.
  • Community Guidelines.
  • Applicable laws.

Flare does not adopt or endorse Community content simply because it appears on the Platform.

Community Chats

Communities may include chat features.

Community Chats are intended for discussions relevant to the Community.

Members must not use Community Chats to:

  • Spam.
  • Harass others.
  • Promote illegal activity.
  • Send malicious links.
  • Conduct scams.
  • Flood conversations.
  • Repeatedly disrupt discussions.

Community owners and moderators may remove messages where Platform tools allow.

Flare may also intervene where necessary to protect users or comply with legal obligations.

Community Names & Descriptions

Community names, descriptions and images must not:

  • Be misleading.
  • Promote illegal activity.
  • Promote hate organisations.
  • Include explicit public sexual content.
  • Infringe intellectual property rights.
  • Encourage violence.
  • Impersonate Flare or another organisation.

Flare may edit, rename or remove Communities that violate these standards.

Community Discovery

Communities may appear within Flare’s discovery features.

Community recommendations do not constitute endorsement by Flare.

Flare may determine Community visibility using factors including:

  • Activity.
  • Member engagement.
  • Safety considerations.
  • User preferences.
  • Platform integrity.

Flare does not guarantee Community visibility.

Private Communities

Some Communities may be designated as private or invitation-only.

Private Communities may restrict:

  • Membership.
  • Posts.
  • Comments.
  • Community Chats.
  • Visibility.

Community owners are responsible for deciding who may join, subject to Platform tools and applicable law.

Community Events

Communities may organise Meetups or other gatherings.

Such events remain subject to:

  • Chapter 10 (Meetups).
  • These Terms.
  • Community Guidelines.

Community ownership does not transfer responsibility for Meetup organisation to Flare.

Commercial Activity

Communities must not be used primarily for unauthorised commercial activity.

Unless expressly permitted by Flare, members must not use Communities to:

  • Spam advertisements.
  • Operate pyramid schemes.
  • Conduct unauthorised fundraising.
  • Promote prohibited products or services.
  • Send unsolicited commercial messages.

Authorised business activity should take place through approved Platform features, such as Services or sponsored advertising.

Community Enforcement

Flare may take action against Communities or Community members where reasonably necessary.

Enforcement may include:

  • Content removal.
  • Warning notices.
  • Community restrictions.
  • Temporary suspension.
  • Community closure.
  • Removal of owners or moderators.
  • Permanent account termination in serious cases.

Enforcement decisions are made in accordance with these Terms and the Community Guidelines.

No Endorsement

Communities represent the views of their members, not Flare.

The existence of a Community does not mean that Flare:

  • Supports its opinions.
  • Verifies its information.
  • Endorses its activities.
  • Guarantees the behaviour of its members.

Users remain responsible for evaluating the Communities they choose to join.

Your Responsibility

When participating in Communities, you remain responsible for:

  • Your conduct.
  • Your posts.
  • Your comments.
  • Your interactions.
  • Respecting the privacy of other members.
  • Complying with these Terms.

Community participation is at your own discretion and risk.

Future Features

Flare may introduce additional Community features over time, including:

  • Community announcements.
  • Community events.
  • Community roles.
  • Community verification.
  • Community discovery improvements.
  • AI-assisted moderation tools.
  • Additional moderation controls.

Unless otherwise stated, these Terms will apply to future Community features.

10. Meetups

Purpose

Flare allows eligible users to create, organise and participate in Meetups.

Meetups are intended to help adults connect through shared interests, social activities, community events and other lawful gatherings.

Meetups are created and managed by users.

Flare provides the technology that allows users to organise these events but does not organise, supervise or control them.

Eligibility to Host

Only users who satisfy Flare’s eligibility requirements may host Meetups.

Depending on your location and applicable law, hosting may require:

  • Age verification.
  • Identity verification through Didit.
  • A verified Flare account.
  • Compliance with these Terms.
  • Compliance with the Community Guidelines.

Flare may refuse or revoke hosting privileges where reasonably necessary to protect users or comply with legal obligations.

Creating a Meetup

When creating a Meetup, hosts agree to provide information that is:

  • Accurate.
  • Lawful.
  • Up to date.
  • Not misleading.

This includes, where applicable:

  • Event title.

Hosting a Meetup does not create an employment, agency or partnership relationship with Flare.

Attendee Responsibilities

Users attending Meetups remain responsible for their own decisions and behaviour.

Attendees agree to:

  • Respect hosts.
  • Respect venue rules.
  • Respect other attendees.
  • Follow applicable laws.
  • Behave responsibly.
  • Leave an event if requested by the organiser where appropriate.

Attendees remain responsible for assessing whether a Meetup is suitable for them.

Venues

Meetups may take place in:

  • Public places.
  • Commercial venues.
  • Community spaces.
  • Private venues where lawful.

Hosts are responsible for ensuring they have any permissions required to use a venue.

Flare does not verify venue availability, ownership or suitability.

Identity Verification for Hosts

Where identity verification is required, hosts must complete verification before organising Meetups.

Verification is performed by Didit.

Flare receives only the verification outcome and does not receive or retain verification selfies or identity documents.

Identity verification improves trust but does not guarantee a host’s conduct or reliability.

Community Meetups

Communities may organise Meetups.

Community ownership does not transfer responsibility for organising Meetups to Flare.

The organiser identified for the Meetup remains responsible for the event.

Attendance

Hosts may establish reasonable attendance requirements, including:

  • Maximum attendance.
  • RSVP requirements.
  • Capacity limits.
  • Dress codes where lawful.
  • Age restrictions beyond Flare’s minimum age where lawful.
  • Venue-specific requirements.

Hosts should apply attendance requirements fairly and lawfully.

Event Changes & Cancellation

Hosts may modify or cancel Meetups.

Where practical, hosts should notify attendees as soon as reasonably possible if:

  • The location changes.
  • The time changes.
  • Capacity changes.
  • The Meetup is cancelled.

Flare is not responsible for losses arising from changes made by Meetup organisers.

Paid Events

Some Meetups may involve admission charges or other costs.

Unless Flare expressly provides payment processing for a particular feature:

  • Financial arrangements are solely between the organiser and attendees.
  • Flare is not responsible for collecting payments.
  • Flare is not responsible for refunds.
  • Flare is not responsible for disputes relating to event fees.

Hosts are responsible for complying with applicable consumer protection and tax laws.

Alcohol, Drugs & Illegal Activity

Meetups must not be used to facilitate:

  • Illegal drug activity.
  • Violence.
  • Human trafficking.
  • Sexual exploitation.
  • Criminal activity.
  • Hate groups.
  • Illegal weapons.
  • Any activity prohibited by applicable law.

Where alcohol is present, hosts and attendees remain responsible for complying with local licensing and legal requirements.

Photography & Recording

Photographs and videos taken during Meetups should respect the privacy and consent of attendees.

Where required by law or where reasonably expected, organisers should obtain appropriate consent before recording or publishing identifiable images of attendees.

Flare is not responsible for photographs or recordings made by Meetup participants.

Safety

Flare encourages all users to prioritise their personal safety when attending Meetups.

Users should:

  • Meet in appropriate locations.
  • Inform trusted contacts where appropriate.
  • Use Flare’s Safety Check-In features where available.
  • Leave immediately if they feel unsafe.
  • Contact emergency services where immediate assistance is required.

Reports

Users may report Meetups that appear to:

  • Violate these Terms.

No Endorsement

The appearance of a Meetup on Flare does not mean that Flare:

  • Organises the event.
  • Endorses the organiser.
  • Guarantees attendance.
  • Guarantees safety.
  • Verifies every detail of the event.

Meetups remain user-generated activities.

Limitation of Responsibility

To the fullest extent permitted by applicable law, Flare is not responsible for:

  • Injuries.
  • Property damage.
  • Financial loss.
  • Personal disputes.
  • Travel expenses.
  • Accommodation costs.
  • Event cancellations.
  • Conduct of organisers.
  • Conduct of attendees.

Users attend Meetups entirely at their own discretion and risk.

Nothing in this section limits liability that cannot legally be excluded under applicable law.

Flare may introduce additional Meetup features, including:

  • Verified hosts.

11. Venues

Purpose

Flare’s Venue feature helps users discover LGBTQ+ friendly and inclusive places to meet, socialise and participate in community life.

Depending on your location, Venues may include:

  • Bars.
  • Clubs.
  • Cafés.
  • Restaurants.
  • Community centres.
  • Saunas.
  • Hotels.
  • Entertainment venues.

The purpose of the Venue feature is to help users discover locations that may be relevant to their interests.

Venue Information

Venue information displayed on Flare may come from a variety of sources, including:

  • Publicly available business information.

  • Business owners.
  • Venue managers.
  • User contributions.
  • User reviews.
  • User photographs.

Although we aim to provide accurate information, Flare cannot guarantee that all Venue information is complete, accurate or current.

Business Owners & Venue Managers

Where supported, verified business owners or authorised venue managers may claim or manage their Venue listing.

Business owners are responsible for ensuring that information they publish is:

  • Accurate.
  • Up to date.
  • Lawful.
  • Not misleading.

  • Opening hours.
  • Contact information.
  • Venue descriptions.
  • Photos.

User Reviews

Users may have the ability to leave reviews and ratings for Venues.

Users must not:

  • Publish fake reviews.
  • Accept payment for reviews without disclosure.
  • Coordinate review manipulation.

Flare may remove reviews that violate these Terms.

Venue Photographs

Users may upload photographs of Venues where permitted.

You must only upload photographs that:

  • You have permission to share.

Flare may remove photographs that violate these standards.

Venue Check-Ins

Flare may allow users to check in at participating Venues.

Check-ins are optional.

  • Individual users are not identified through aggregate statistics.

Users remain responsible for deciding whether to check in.

Safety Check-Ins

Flare may classify Venues using information obtained from:

Venue classifications are intended to improve discovery but may occasionally be inaccurate.

Users should independently confirm important details before visiting a Venue.

Events at Venues

Venues may host:

Hosting a Meetup at a Venue does not imply that:

  • The Venue is operated by Flare.
  • The Venue has been inspected by Flare.
  • The Venue has been endorsed by Flare.

Responsibility for Meetups remains with the organiser.

No Endorsement

The inclusion of a Venue within Flare does not mean that Flare:

  • Owns the Venue.
  • Operates the Venue.
  • Endorses the Venue.
  • Verifies every business.
  • Guarantees services provided by the Venue.
  • Guarantees user experiences.

Venue listings are provided for informational and discovery purposes.

User Responsibility

Users remain responsible for their decisions to:

  • Visit a Venue.
  • Meet other users.
  • Attend events.
  • Purchase goods or services.
  • Follow Venue rules.

Users should exercise appropriate judgement and prioritise their personal safety.

Reports

12. Services

Purpose

Flare allows eligible users to advertise personal or business services through the Platform.

The Services feature is intended to help adults discover lawful services offered by other verified users.

Flare provides the technology that allows users to publish Service listings but does not provide, supervise or guarantee the services themselves.

All agreements are made directly between users.

Eligibility

Only eligible users may create a Service listing.

To publish a Service, you must:

  • Be at least 18 years old.
  • Maintain a Flare account in good standing.
  • Complete any required identity verification through Didit.
  • Comply with these Terms.
  • Comply with the Community Guidelines.
  • Comply with applicable laws.

Flare may refuse or remove Service listings where these requirements are not met.

  • Contact through Direct Messages.

Service listings must accurately describe the service being offered.

Misleading or deceptive listings are prohibited.

Public Content Standards

Because Service listings are visible to all users, they must remain suitable for public display.

Service titles, descriptions and cover images must not include:

  • Explicit sexual language.
  • Graphic sexual descriptions.
  • Explicit nudity.
  • Fetish terminology intended for public advertising.
  • Pornographic imagery.
  • Illegal services.
  • Hate speech.
  • Threats.
  • Misleading claims.

Adult-oriented services may be offered only where lawful and only if advertised using appropriate, non-explicit language that complies with the Community Guidelines.

Flare reserves the right to edit, reject or remove listings that are considered excessively explicit for public display.

Pricing

Flare does not require service providers to display prices publicly.

Pricing, quotations and payment arrangements should be discussed privately through Direct Messages.

Users remain responsible for ensuring any agreements comply with applicable consumer protection, tax and other legal requirements.

Duration

Each eligible account may publish one standard Service listing free of charge for 7 days.

When the free listing expires, users may purchase an extension through the Platform.

At the time these Terms were last updated:

  • A 30-day extension costs £30.

Prices, durations and available promotional options may change over time.

Current pricing will always be displayed before purchase.

Payments

Payment for Service listing extensions is made through Flare’s supported payment systems.

The listing fee pays only for increased visibility and continued publication of the listing.

Flare does not process payments between service providers and their customers unless we expressly introduce that functionality in the future.

Service Agreements

Any agreement entered into between a service provider and another user is solely between those individuals.

Flare is not:

  • A party to the agreement.
  • An employer.
  • An employment agency.
  • A recruitment agency.
  • A booking agent.
  • A payment intermediary (unless expressly stated).

Users remain solely responsible for negotiating and fulfilling any agreement.

Provider Responsibilities

13. Private Albums & Protected Media

Private Albums allow users to share selected photographs and videos with specific users of their choosing.

Unlike public profile media, Private Albums are intended for limited, controlled sharing between consenting adults.

Access to a Private Album is granted solely by the album owner.

Granting Access

Only the owner of a Private Album may decide who can access it.

Album owners may:

  • Grant access.
  • Revoke access.
  • Limit access to selected users.
  • Remove users at any time.
  • Delete media.
  • Delete the entire album.

Granting access does not transfer ownership of any media.

Temporary Access

Because operating systems differ, these protections cannot be guaranteed on every device.

Consent to view media is not consent to further distribute or reproduce it.

Additional permission from the owner is required unless otherwise permitted by law.

Reporting Unauthorised Sharing

If you believe media from your Private Album has been shared without your permission, you should report the incident through Flare’s reporting tools as soon as possible.

Where appropriate, Flare may:

  • Investigate the report.
  • Review watermark information.
  • Review screenshot attribution data.
  • Restrict accounts.
  • Remove content.
  • Suspend or terminate accounts.
  • Cooperate with law enforcement where legally required.

Flare cannot guarantee recovery or removal of content that has already been distributed outside the Platform.

AI & Safety Review

Private Album content is not routinely reviewed by Flare.

However, where reasonably necessary, protected media may be reviewed in limited circumstances, including:

  • Investigation of user reports.
  • Detection of illegal content.
  • Compliance with legal obligations.
  • Protection of users.
  • Enforcement of these Terms.

Failure to cooperate may influence the outcome of an investigation.

False Reports

We encourage users to report genuine safety concerns.

However, users must not knowingly submit:

  • False reports.
  • Malicious reports.
  • Retaliatory reports.
  • Frivolous reports intended to harass another user.

Abuse of the reporting system may result in enforcement action.

Compliance with Law

Flare may take enforcement action where reasonably necessary to comply with:

  • Court orders.
  • Regulatory requirements.
  • Criminal investigations.
  • Child safety obligations.
  • Online safety legislation.
  • Other applicable legal requirements.

Nothing in these Terms limits our ability to comply with lawful requests from competent authorities.

Effect of Termination

If your account is permanently terminated:

  • Your right to use the Platform immediately ends.
  • Active subscriptions may end in accordance with the applicable payment provider’s policies and applicable law.
  • Access to Communities, Meetups, Services and other Platform features may be removed.
  • Certain information may be retained where required by law or reasonably necessary for fraud prevention, safety or legal claims, as described in our Privacy Policy.

Reservation of Rights

Nothing in this chapter limits Flare’s ability to take any lawful action reasonably necessary to:

  • Protect users.
  • Protect employees and moderators.
  • Protect the Platform.
  • Protect our intellectual property.
  • Comply with legal obligations.
  • Preserve the integrity of our services.

21. Disclaimers & Limitation of Liability

Availability of the Platform

Flare is provided on an “as available” and “as is” basis, to the fullest extent permitted by applicable law.

Although we work to provide a reliable and secure Platform, we do not guarantee that:

  • The Platform will always be available.
  • The Platform will always operate without interruption.
  • The Platform will always be error-free.
  • Every feature will always remain available.
  • Every defect can be corrected immediately.

Temporary interruptions may occur due to:

  • Maintenance.
  • Security updates.
  • Software updates.
  • Technical failures.
  • Third-party service outages.
  • Events outside our reasonable control.

User Interactions

Flare provides technology that enables users to connect.

We do not supervise every interaction between users.

Accordingly, Flare does not guarantee:

  • The identity of every user.
  • The accuracy of profile information.
  • Compatibility between users.
  • The behaviour of users.
  • The honesty of users.
  • That interactions will be safe or successful.

Users remain responsible for exercising appropriate judgement when interacting with others.

Meetups

Meetups are organised entirely by users.

Flare:

  • Does not organise Meetups.
  • Does not supervise Meetups.
  • Does not employ Meetup organisers.
  • Does not inspect Meetup venues.
  • Does not guarantee attendee behaviour.

Attendance at any Meetup is entirely voluntary and at your own risk.

Communities

Communities are created and managed by users.

Flare does not:

  • Endorse Community opinions.
  • Verify Community information.
  • Guarantee Community behaviour.
  • Accept responsibility for Community decisions.

Community owners and moderators remain responsible for managing their Communities.

Venues

Venue listings are provided for informational purposes.

Flare does not guarantee:

  • Opening hours.
  • Availability.
  • Accessibility.
  • Business practices.
  • Safety.
  • Accuracy of third-party information.

Users should independently verify important information before visiting a Venue.

Services

Services are offered by independent users or businesses.

Flare does not:

  • Employ Service providers.
  • Recommend providers.
  • Guarantee qualifications.
  • Guarantee results.
  • Guarantee availability.
  • Guarantee pricing.

Contracts for Services exist solely between the provider and the customer.

Third-Party Services

Certain features depend on third-party providers.

Examples include:

  • Authentication.
  • Payments.
  • Maps.
  • Messaging.
  • Voice and video calls.
  • AI services.
  • Verification.
  • Cloud hosting.
  • Advertising.

Flare is not responsible for interruptions caused by third-party providers beyond our reasonable control.

No Guarantee of Results

Flare cannot guarantee:

  • Matches.
  • Friendships.
  • Relationships.
  • Business success.
  • Community growth.
  • Service bookings.
  • Meetup attendance.
  • Venue popularity.

Platform features increase opportunities for connection but cannot guarantee outcomes.

Technical Limitations

Certain features depend upon:

  • Device compatibility.
  • Operating systems.
  • Internet connectivity.
  • Third-party infrastructure.
  • Local laws.

As a result, features may operate differently across devices or regions.

Security

Although Flare uses industry-standard security measures, no online platform can guarantee absolute security.

Users remain responsible for:

  • Protecting their accounts.
  • Protecting their devices.
  • Using strong authentication.
  • Exercising caution online.

Indirect Losses

To the fullest extent permitted by law, Flare is not liable for indirect or consequential losses, including:

  • Loss of profits.
  • Loss of business opportunities.
  • Loss of goodwill.
  • Loss of reputation.
  • Loss of data.
  • Emotional distress arising solely from use of the Platform.
  • Interrupted communications.

This limitation applies only where permitted by applicable law.

Liability Cap

To the fullest extent permitted by applicable law, Flare’s total liability arising out of or relating to the Platform shall not exceed:

  • the total amount you paid to Flare during the 12 months immediately preceding the event giving rise to the claim; or
  • £100, if you have not made any payment to Flare during that period,

whichever amount is greater.

This limitation does not apply where liability cannot legally be limited.

Non-Excludable Rights

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence.
  • Fraud or fraudulent misrepresentation.
  • Wilful misconduct where liability cannot be excluded.
  • Any statutory consumer rights that cannot legally be excluded or limited.
  • Any liability that applicable law prohibits us from limiting.

Your mandatory legal rights remain unaffected.

Force Majeure

Flare is not responsible for delays or failures caused by events beyond our reasonable control, including:

  • Natural disasters.
  • War.
  • Terrorism.
  • Civil unrest.
  • Government action.
  • Power failures.
  • Internet outages.
  • Cyber attacks.
  • Labour disputes.
  • Epidemics or pandemics.
  • Failures of third-party infrastructure.

We will make reasonable efforts to restore the Platform as soon as practicable.

Consumer Rights

If you are a consumer, nothing in these Terms affects any mandatory rights available to you under the laws of your country of residence.

Where local consumer laws provide greater protection than these Terms, those mandatory rights will prevail.

Interpretation

The limitations in this chapter apply to the fullest extent permitted by applicable law.

If any limitation is found unenforceable, the remaining provisions continue in effect.

22. Governing Law, Disputes & Legal Matters

Governing Law

These Terms, the Community Guidelines and the Privacy Policy are governed by the laws of England and Wales, except where mandatory consumer protection laws in your country of residence provide otherwise.

Nothing in these Terms limits any legal rights that cannot be excluded under applicable law.

Jurisdiction

If you are using Flare as a consumer, you may bring legal proceedings:

  • In the courts of England and Wales; or
  • In the courts of your country of habitual residence where applicable law permits.

If you are using Flare for business purposes, any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales unless otherwise agreed in writing.

Resolving Disputes

Before starting formal legal proceedings, we encourage users to contact Flare through the Help Center so we can try to resolve disputes quickly and fairly.

Many issues can be resolved without court proceedings.

Nothing in this section prevents either party from seeking urgent legal relief where necessary.

Consumer Rights

If you are a consumer, these Terms do not affect any statutory rights that cannot legally be excluded or limited.

Where local consumer protection laws provide greater rights than these Terms, those mandatory rights will apply.

Regulatory Compliance

Flare operates in multiple jurisdictions and may modify features, policies or Platform functionality to comply with applicable laws and regulatory requirements.

Examples include laws relating to:

  • Online safety.
  • Privacy.
  • Consumer protection.
  • Age assurance.
  • Advertising.
  • Payments.
  • Digital services.

Compliance measures may differ depending on the country in which you use the Platform.

Electronic Communications

You agree that Flare may communicate with you electronically.

  • In-app notifications.
  • Push notifications.
  • Website notices.
  • Other electronic communications made available through the Platform.

Electronic communications satisfy any legal requirement that communications be in writing, where permitted by applicable law.

Entire Agreement

These documents together form the entire agreement between you and Flare regarding your use of the Platform:

  • Community Guidelines.
  • Privacy Policy.
  • Any additional feature-specific terms presented within the Platform.

They replace any previous agreements relating to your use of Flare.

Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction:

  • That provision shall be interpreted to the minimum extent necessary to make it enforceable where permitted by law; or
  • If it cannot be enforced, it shall be treated as removed.

The remainder of these Terms will continue in full force and effect.

No Waiver

If Flare delays or chooses not to enforce any provision of these Terms, this does not mean we waive our right to enforce that provision or any other provision in the future.

Any waiver must be made expressly and in writing.

Assignment

Flare may transfer or assign its rights and obligations under these Terms:

  • As part of a merger.
  • During an acquisition.
  • During a corporate restructuring.
  • As part of a sale of assets.
  • Where otherwise permitted by law.

You may not transfer your rights or obligations under these Terms without Flare’s prior written consent.

No Partnership

Nothing in these Terms creates:

  • An employment relationship.
  • A partnership.
  • A joint venture.
  • An agency relationship.
  • A franchise.
  • A fiduciary relationship.

Users act independently when using the Platform.

Survival

The following provisions continue to apply after your account is deleted or these Terms otherwise end, to the extent reasonably necessary:

  • Intellectual Property.
  • User Content licences.
  • Privacy obligations.
  • Enforcement actions.
  • Disclaimers.
  • Limitation of Liability.
  • Governing Law.
  • Dispute Resolution.
  • Any provisions intended by their nature to survive termination.

Where changes are material, we will provide notice through the Platform, by email, or by other reasonable means where required by applicable law.

The “Last updated” date at the beginning of these Terms will also be revised.

Continued Use

By continuing to use Flare after updated Terms become effective, you agree to the revised Terms, unless applicable law requires a different process or grants you additional rights.

If you do not agree with the updated Terms, you should stop using the Platform and may delete your account at any time.

23. Additional Terms for Apps Downloaded from the Apple App Store

This section applies only where you obtained the Flare application from the Apple App Store. It is required by Apple and forms part of these Terms. Where this section conflicts with any other part of these Terms, this section prevails, but only in respect of the App Store version of the application.

In this section, “Application” means the Flare iOS, iPadOS or watchOS application downloaded from the Apple App Store, and “Apple” means Apple Inc. and its subsidiaries.

Acknowledgement

You and Flare acknowledge that these Terms are concluded between you and Backroom Studio Ltd only, and not with Apple.

Backroom Studio Ltd, not Apple, is solely responsible for the Application and its content.

Scope of Licence

The licence granted to you for the Application is a non-transferable licence to use the Application on any Apple-branded product that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.

The Application may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing, where Apple makes those features available.

Maintenance and Support

Backroom Studio Ltd is solely responsible for providing any maintenance and support services for the Application, as specified in these Terms or as required under applicable law.

You and Backroom Studio Ltd acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services in respect of the Application.

Warranty

Backroom Studio Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent they have not been effectively disclaimed.

In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Application to you, if any.

To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Backroom Studio Ltd.

Nothing in this section affects any statutory rights you have as a consumer that cannot legally be excluded or limited.

Product Claims

Backroom Studio Ltd, not Apple, is responsible for addressing any claims from you or any third party relating to the Application or your possession and use of the Application, including:

  • Product liability claims.
  • Any claim that the Application fails to conform to any applicable legal or regulatory requirement.
  • Claims arising under consumer protection, privacy or similar legislation.

Intellectual Property Rights

In the event of any third-party claim that the Application, or your possession and use of the Application, infringes that third party’s intellectual property rights, Backroom Studio Ltd, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of any such claim.

Legal Compliance

You represent and warrant that:

  • You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country.
  • You are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with any applicable third-party terms of agreement when using the Application.

Third-Party Beneficiary

You and Backroom Studio Ltd acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of them.
